Abstract

The need for jurisprudential grounding of banking transactions has become certain, as they continue to complicate in our present time. The occurrences in these contemporary transactions are renewed and it is essential to base them on jurisprudence.

The necessity for people to deal with bank checks, or sales by installments or leases that end with ownership, ect, is steadily growing. There fore, we will attempt in the article to answer the following questions :

How can the use of bank checks be established in light of islamic jurisprudence ?

What drew me to choose this topic is the confirmed need to establish these new banking tranactions so that muslims feel assured when dealing with them.

As for the objectives of this work ,they are :

  • To examine the dealing with bank checks while clarifying their juristic grounding.
  • To demonstrate the ability of islamic jurisprudence to accommodate these new banking transactions.
